THE ACCIDENT WAS NOT MY FAULT. I WAS HIT FROM BEHIND. MY SON AND I WERE INJURED. I HAD TO BE EXTRACTED FROM THE VEHICLE. THE EMERGENCY PERSONAL COULD NOT OPEN THE PASSENGER DOOR TO REMOVE ME FROM THE VEHICLE. THEY HAD TO GO THROUGH THE BACK SEAT. I HAD COMPLAINED TO YOU AND BMW REGARDING THE SAFETY HAZARD OF THIS VEHICLE. BMW WAS SLOW TO REPLY. THE ORIGINAL REPLY WAS THAT I DIDN'T PROVIDE A CLEAR EXPLANATION REGARDING THIS ISSUE. SO, I COMPLAINED AGAIN. THERE RESPONSE WAS UNTIMELY AND THIS ENTIRE SAFETY ISSUE HAS RESULTED IN A VERY TRAUMATIC EXPERIENCE. I HAD ADVISED YOU AND BMW THAT THIS WAS A SAFETY ISSUE. NO ONE RESPONDED IN A TIMELY MANNER. HOW MANY MORE FAMILIES WILL HAVE TO EXPERIENCE THIS TYPE OF TRAUMA BEFORE YOU RECALL THIS VEHICLE? WHAT ARE YOU GOING TO DO ABOUT THIS? THE VEHICLE STARTED SMOKING FROM UNDER THE HOOD WHILE DRIVING IN TOWN TO THE POST OFFICE. UPON PARKING THE VEHICLE AT THE POST OFFICE, IT CAUGHT FIRE UNDER THE HOOD AND THE FIRE DEPT. HAD TO BE CALLED TO FORCE OPEN THE HOOD TO PUT OUT THE FIRE. THE ENTIRE FRONT OF THE VEHICLE WAS DAMAGED IN FRONT OF THE FIRE WALL. THE USPS MOVED EMPLOYEES/CUSTOMERS TO THE REAR OF THE BUILDING FOR PRECAUTION OF EXPLOSION AND SMOKE INHALATION OF THE BURNING PLASTIC, RUBBER AND RELATED PARTS. IT WAS FORTUNATE I COULD QUICKLY PARK RATHER THAN BEING ON THE HIGHWAY.
SEAT-WARMER OVERHEATED, BURNING HOLES THROUGH THE LEATHER DRIVER'S SEAT, CAUSING MINOR SKIN BURNS BEFORE TERMINATING USE OF UNIT. OVER THE PAST TWO MONTHS, I HAD NOTICED A BURNING ODOR IN THE CAR PERIODICALLY, BUT NEITHER I NOR MY MECHANIC HAD BEEN ABLE TO DETERMINE THE SOURCE OF THE ODOR. ON 1/27/12, I FELT THE EXTREME HEAT IN MY SEAT WHILE DRIVING, AND FOUND TWO CHARRED HOLES IN THE LEATHER SEAT. IT IS IMPORTANT TO NOTE THAT THERE WAS NOT A FIRE PER SE, BUT IN ORDER TO REGISTER THE FACT THAT THERE WAS (MINOR) INJURY ATTRIBUTED TO ONE PERSON, THIS FORM REQUIRED STATING "YES" TO THE QUESTION REGARDING FIRE. THE MANUFACTURER STATED THAT THERE WERE NO OPEN RECALLS BASED ON HER VIN, BUT NHTSA CAMPAIGN ID NUMBER 04V575000 (SEATS:FRONT ASSEMBLY:SEAT HEATER/COOLER) WAS REFERENCED. THE FAILURE AND CURRENT MILEAGES WERE LESS THAN 54,000.

WHILE TRAVELING AND SLOWING DOWN TO MAKE A TURN INTO A BUSINESS, THE CAR BESIDE ME (LEFT OF ME) MAKES A QUICK FAST U TURN AND ENDS UP HITTING MY CAR. AIRBAGS DEPLOYED, HITTING ME INTO MY FACE/HEAD VERY HARD. I HAVE BEEN IN TREATMENT SINCE. I HAVE HAD TO HAVE MAJOR SURGERY ON MY NECK, STILL HAVE PROBLEMS AND MAY NEED MORE SURGERY. MY NECK WILL NOT BE THE SAME AND ALWAYS IN PAIN. I HAVE LOUD RINGING IN MY EARS THAT IS PERMANENT. I HAVE HEADACHES WITH SINUS PROBLEMS. I BELIEVE I WOULD HAVE BEEN FINE WITH MY SEAT BELT ON. I HAVE SUSTAINED A CERVICAL AND A THORACIC SPINE INJURY (HERNIATED DISCS) AND CONTINUE TO BE UNDER MEDICAL TREATMENT FOR THE PAST 10 MONTHS. THE CONTACT THEN TOOK THE VEHICLE TO THE DEALER WHERE THEY REPLACED THE HEATED SEAT ELEMENT, BUT NOT THE ACTUAL SEAT. THE VIN WAS NOT AVAILABLE. THE FAILURE AND THE CURRENT MILEAGES WERE 89,000.

ALSO, THE MECHANIC STATED THAT THE VEHICLE WAS NOT INCLUDED ON ANY RECALLS. THE VEHICLE WAS NOT REPAIRED. THE MANUFACTURER WAS MADE ARE OF THE FAILURE WHO REFERRED HIM TO NHTSA. THE FAILURE MILEAGE WAS 75,000.
